Allowed, subject to all just exceptions. Application is disposed of. 2.

The present petition has been filed by the Petitioner - Pawan @ Ram Sala under Article 226 of the Constitution of India read with Section 528 BNSS seeking extension of furlough for the period of two weeks to perform the last rites (tervi) of his mother, which is to be held on 19th June, 2025 on humanitarian ground in FIR No. 245/2013 under Section 302 IPC, Police Station - Subzi Mandi, Delhi.

Mr. Shannu Baghel, ld. Counsel appearing for the Petitioner submits that the Petitioner herein was released on the 2nd spell of furlough for a period of two weeks on 2nd June, 2025 and the Petitioner has to surrender on 17th June, 2025. In the present petition, it is submitted that the Petitioner be granted extension of furlough for a period of two weeks on humanitarian grounds to perform the last rites and ceremonies of the mother of the Petitioner, who has expired on 9th June, 2025.

A status report has been filed on behalf of the Respondent/ State along with the statement of neighbours and the death certificate of the mother of the Petitioner. The same are taken on record. The relevant portion of the said status report is extracted hereunder :

"That, on receiving of the copy of petition filed by petitioner Pawan @ Ram Sala before this Hon'ble Court regarding extension of furlough on the ground of death of his mother, enquiry has been conducted at the given address of the petitioner i.e. H. No. 4786, Gali Mitrawali, Roshnara Road, Subzi Mandi, Delhi. During enquiry, two neighbours of the locality have been examined and they have confirmed that the mother of petitioner namely Ram Devi has expired on 9th June, 2025. Besides it, the cremation slip attached with the petition has also been verified from the Nigam Bodh Ghat, Yamuna Bazar Delhi and same has been found genuine."

Ms. Priyam Aggarwal, ld. Counsel appearing on behalf of Mr. Sanjay Lao, ld. Standing Counsel (Crl.) for State submits that the State has no objection in extending the furlough for a period of one week. 7.

Keeping in view all the submissions of the ld. Counsels appearing for the parties and the fact that the date of tervi of the mother of the Petitioner is now fixed for 19th June, 2025, the period of furlough is extended till 22nd June, 2025 on the same terms and conditions on which the furlough was granted on 2nd June, 2025.

The Petitioner shall positively surrender before the concerned Jail The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Superintendent on 22nd June, 2025 at 05:00 PM. 9.

With the above conditions, the present petition is disposed of. 10.

Copy of the order be sent to the concerned Jail Superintendent for information and necessary compliance.
