Counsel for Petitioner suggests that considering the prayer sought in CM APPL. 41136/2024 to refer the parties to the Expert Settlement Council, the writ petition itself can be disposed of. Counsel for Respondent des not object to the same. Accordingly, with the consent of both counsel, the petition is taken up for hearing.

On 04th July, 2024, Respondent No. 2/ NTPC Limited had informed the Court about the commencement of process for appointment of Expert Settlement Council. Settlement Council, as per their request. Counsel for Petitioner submits that the Court may consider issuing directions for constitution of the Council and disposal in a timebound manner.

Counsel for the Respondent states that the Expert Settlement Council shall be in place within three weeks from today, and they shall decide the matter within the stipulated timelines.

Taking the statement of Respondent's counsel on record, the present petition is disposed of, along with the pending application. 5.

It is clarified that the Court has not examined the merits of the case. All rights and contentions of the parties are left open. 6.

In case the Petitioner is aggrieved with the outcome of proceedings before the Expert Settlement Council, they shall be free to take recourse to appropriate remedies available in law.
