% 23.01.2020 On 20.09.2019 the following order was passed: "Subject to the deposit of the decretal amount including the mesne profits at the rate of Rs.15,000/- per month till date within a week from today, the notice of this appeal be issued to the respondent. On deposit of the amount, the execution, if any, shall remain stayed till the next date of hearing. The appellant shall continue deposit in this Court Rs.15,000/- per month on or before 7th day of each calendar month as future user charges of the premises till the vacation of the premises. Electricity and water charges shall be paid as per actual." It is submitted by the learned counsel for the respondent the said order has not been complied with by the appellant. Even the office noting shows nothing is deposited as was ordered on 20.09.2019. Even none appears on behalf of the appellant despite two calls.

It seems the appellant is not interested to pursue the appeal. In the circumstances, the appeal is dismissed in default for nonprosecution. Pending application(s) also stands disposed of. Order dasti.
