% 27.02.2024 The court has heard Mr. Raj Shekhar Rao, learned senior counsel appearing for the appellant as also Mr. Ritin Rai, learned senior counsel appearing for respondent No.2 After making some submissions, Mr. Rao submits that the learned Sole Arbitrator has not duly considered the appellant's submission that they be permitted to withdraw the amount lying deposited in this court, subject to furnishing requisite security.

Mr. Rao submits on instructions, that the appellant would be willing to withdraw the present appeal, with liberty to file an appropriate application before the learned Sole Arbitrator, seeking that the aforesaid submission be considered by him, in accordance with law.
In view of the above, present appeal is disposed-of as withdrawn, with liberty as prayed-for.
