Prosecutrix as well as her parents stated to have not been examined by the Trial Court due to strike on 15.11.2019 and the case is now fixed before the Trial Court on 6.12.2019. Trial Court is directed to examine the prosecutrix as well as her parents in terms of order dated 17.10.2019, positively on the next date of hearing.

Learned counsel for the petitioner submitted that he may be allowed to withdraw the present bail application with the liberty to file a fresh bail application before the Trial Court after examination of the prosecutrix as well as her parents. Accordingly, the bail application is dismissed as withdrawn with liberty as prayed for subject to just exceptions. It is

clarified that this Court has not expressed any opinion on the merits of the bail application.
