This bail application is filed on behalf of the applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) for extension of interim bail for a period of six months in FIR No. 270/2018 registered at PS Jagat Puri under Sections 3 and 4 of the Maharashtra Control of Organised Crime Act, 1999.

been granted to the petitioner till 16.06.2025 and today he has to surrender in the jail.

By the present application, the petitioner has prayed for the extension of interim bail for a period of six months on the ground of his medical conditions. As per his medical reports, he has been advised kidney transplant and is undergoing dialysis thrice a week. Thus, further extension is required for treatment of petitioner.

Learned APP has argued that the petitioner was granted interim bail on 17.09.2024 for a period of three months thereafter again on 16.12.2024, the interim bail of the petitioner was extended for another six months. It is further submitted that at present the petitioner can get the required treatment from the various hospitals attached with the jail. It is submitted that the Jail authorities will take all the appropriate steps to get the treatment of various ailments of the petitioner from the hospital, as permissible. 8.
It is relevant here to mention the relevant portion of the impugned order dated 09.06.2025.
"Considering the seriousness of the offence couples with the fact that the charge is yet to be framed, this court does not deem it fit to further extend the interim bail of the applicant for a further period of six months. As the facility is available with the government hospital, the jail authority can made appropriate arrangements to this effect. Considering the situation of the accused, the Medical Superintendent, GTB Hospital with the coordination of Senior Medical Officer, Mandoli Jail is also directed to made appropriate arrangements in advance for the smooth dialysis of the accused."

Keeping in view the submissions of learned APP and the fact that sufficient time is granted to the petitioner for getting his treatment and that he can be very well treated in the hospitals attached to the jail as submitted by learned APP. Accordingly, I do not find any ground for further extension of interim bail.

It is further clarified that, any observation made herein will not impact the decision of the Court on the regular bail application, if any, filed by the petitioner.

However, learned counsel for the petitioner submits that one more day be granted to petitioner to surrender. The request is allowed and the petitioner shall surrender on 17.06.2025 at 05:00 P.M before the concerned Jail Superintendent.

Accordingly, the application is dismissed.
