Writ Petition under Article 226 of Constitution of India read with Section 482 Cr.P.C. has been filed on behalf of the Petitioner for quashing of FIR No.0230/2023 under Section 376 IPC and Section 4 POCSO Act, registered at PS: Vasant Vihar, Delhi, in terms of Settlement Deed dated 28.06.2024.

It is submitted that Prosecutrix has already got married with the Petitioner and one child has born out of their wedlock. 3.
Learned ASC for the State opposed the quashing of FIR on the ground that child was born to the prosecutrix while she was minor and has relied on the Judgment dated 14.11.2025 passed by Co-ordinate Bench of this Court in CRL.M.C.7145/2025, to say that where a child is born during minority of the prosecutrix/victim, it is not a fit case for quashing of FIR. It is indeed a difficult case, where though the parties have eventually got married and also have a child, but it cannot be overlooked that the child was born when the prosecutrix was still a minor. 5.
Relying on the Judgment dated 14.11.2025 passed by Co-ordinate Bench of this Court in CRL.M.C.7145/2025, quashing of FIR No.0230/2023 under Section 376 IPC and Section 4 POCSO Act, registered at PS: Vasant Vihar, Delhi, in terms of Settlement Deed dated 28.06.2024, is denied. 6.
