The learned counsel for the petitioner submits that since the filing of the petition much water has flown. The matter is now listed before the learned Trial Court, for evidence and he is hopeful that the trial would conclude within a short period of time.

In such circumstances, he would raise all his defences before the learned Trial Court. He seeks liberty to withdraw the present petition.

In view of the above, the present petition is dismissed as withdrawn.

The petitioner is at liberty to take all his defences before the learned Trial Court in accordance with law. 5.
