Petitioner/applicant seeks interim bail for a period of 45 days for the reason that his wife has to undergo spinal surgery and there is no one else in the family to take care of her.

Since no document was submitted on record in this regard, the matter was fixed for today and, simultaneously, the petitioner/applicant was directed to supply all such documents to the Investigating Officer and the Investigating Officer was also directed to verify the same and to submit a status report.

Status report has been submitted and as per the status report, the wife of the applicant has to undergo a spinal surgery. The medical documents provided by the petitioner/applicant have also been duly verified and the concerned doctor has also confirmed that the spinal surgery is scheduled for tomorrow i.e.26.06.2025 at Kalra Hospital, Kirti Nagar and the same would be done by Dr. A.K. As per status report, there is no other male member in the family and besides the petitioner/applicant and his wife, he has two minor children and one aged grandmother. Undoubtedly, the allegations against the accused are serious in nature but keeping in mind the fact that there is no other male member in the family and the wife of the petitioner/applicant has to undergo spinal surgery, the case for interim bail is made out.

During course of the arguments, Sh. Sangwan, learned counsel for the petitioner/applicant submitted that he is restricting his request to grant of interim bail for a period of two weeks only and also assures that no request for extension on any ground, whatsoever, would be made.

Keeping in mind the overall facts of the case and also in view of the due verification of the medical documents, the application is allowed and interim bail is granted to the petitioner/applicant for a period of 15 days to be reckoned from the date of his release on his furnishing personal bond and surety bond in the sum of Rs.50,000/- each to the satisfaction of the learned Trial Court/learned Duty MM.
