O R D E R

% 09.02.2016 This is an application moved by the petitioner under Section 439 Cr.PC for grant of interim bail to attend the marriage ceremonies of his niece. Learned Additional Public Prosecutor for the State strongly opposes the bail application on the ground that the petitioner is a desperate criminal having involvement in as many as 16 cases, besides this case. He further submits that the petitioner was convicted in case FIR No.439/2010 under Section 302/397/34 IPC Police Station Saraswati Vihar vide order dated 04.08.2014. His sentence was suspended vide order dated 19.07.2015 and while on bail he committed an offence under Section 302 IPC as such there is every possibility that the petitioner may jump bail and influence / threaten the witnesses. However, he has no objection in case the petitioner is allowed to attend the marriage of his niece in custody. As per the status report, the marriage is scheduled for 12.02.2016 at "Century Grand The Banquet - C, Vikram Enclave, Shalimar Garden Extension - I, Sahibabad (Ghaziabad), Uttar Pradesh"

Accordingly, the Superintendent Jail is directed to make necessary arrangements to take the petitioner to the aforesaid venue for a period of three (3) hours i.e. from 8 pm to 11 pm and to bring him back to jail.

A copy of this order be sent to Superintendent Jail for making necessary arrangements. The application stands disposed of accordingly. A copy of this order be given dasti under the signatures of the Court Master to counsel for the petitioner.
