The petitioner prays that FIR No.446/2005, P.S.Kotla Mubark Pur for offences punishable under Section 406/120B/34 IPC be quashed. 2.
Order dated March 27, 2009 directing listing of the writ petition in the Regular Board with liberty granted to the petitioner to argue the case before the learned Metropolitan Magistrate at the time of framing of the charge.

It is evinced that investigation was warranted on the complaint made and as regards the result thereof, if a closure report was filed, subject to opposition, that would be the end of the matter. If the challan filed evinced cognizance to be taken as per the prosecution, arguments on framing of charge would take place.

Be that as it may, since none appears for the petitioner at the hearing today the petition is dismissed for non-prosecution. 5.
No costs.
