The present application has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS'), seeking grant of interim bail in an FIR No. 178/2025 registered under Section 110 of the Bharatiya Nyaya Sanhita, 2023 ('BNS') at Police Station ('PS') Mundka for a period of 20 days on the ground that he has to perform last rites of his deceased father who unfortunately left for heavenly abode on 14.06.2025. 2.
Learned counsel for the Applicant states that the Applicant's father expired on 14.06.2025 and for this limited purpose, he was released on parole on 16.06.2025 and 18.06.2025.
2.1. He states that since Applicant is the eldest son, he wishes to perform the last rites of his deceased father and relies upon itinerary set out at page 28-29 of the captioned application. He states that all the last rites upto 05.07.2025 have to be performed at Delhi and subsequently the last rites on The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
06.07.2025 and 07.07.2025 have to be performed at Bodh Gaya, Bihar. 2.2. He states that the Applicant has no other criminal priors. He states that the Applicant has earlier been released on interim bail vide order dated 13.05.2025 for a period of one (1) week and the Applicant had duly surrendered after the expiry of the said interim bail. 2.3. He states that the chargesheet already stands filed. 3.
Issue notice. Ms. Manjeet Arya, learned APP for State accepts notice. 3.1. She states that the death of the father of the Applicant has been verified. She also confirms that the Applicant had duly surrendered after expiry of the interim bail granted vide order dated 13.05.2025. 4.
In view of the aforesaid facts, the Applicant is directed to be released on interim bail on the grounds as mentioned above, from the date of his release until 12.07.2025 on furnishing bail bond in the sum of Rs. 50,000/- with one surety of the like amount, subject to the satisfaction of the Jail Superintendent/Magistrate/Trial Court, and further subject to the following conditions:
(i) Applicant will not leave the country without prior permission of the Court.
(ii) Applicant shall intimate the change of his address to the concerned IO/Court. The Applicant shall report to the IO on every Wednesday at the PS between 10:00 AM and 11:00 AM. The IO shall ensure that the Applicant is not kept waiting for more than one hour. (iii) Applicant shall provide the permanent address to the I.O./Jail Superintendent/Magistrate/Trial Court.
(iv) Applicant shall provide all mobile numbers to the IO concerned which shall be kept in working condition at all times and shall not The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(v) Applicant shall not indulge in any criminal activity and shall not communicate with or come in contact with any of the prosecution witnesses, the victim/complainant or any member of the victim/complainant's family or witness or tamper with the evidence of the case.
(vi) Applicant shall surrender before the Jail Superintendent on or before 12.07.2025 without seeking any extension of interim bail. 5.
Copy of the order be sent to the Jail Superintendent for information and necessary compliance.

Accordingly, the application is disposed of.
