The petitioner has filed the present petition, inter alia, impugning an order dated 29.01.2019 passed by respondent, whereby the petitioner's request for grant of furlough was rejected.

The petitioner's request was denied in view of the Rule 1223(i) of the Delhi Prison Rules, 2018, which requires a convict to have three annual good conduct reports in order to be eligible for grant of furlough. In the present case, it is stated that the petitioner was awarded punishment of suspension of mulakats for a period of one month, on 24.02.2017. 3.

In view of the above, the petitioner does not qualify for furlough. The petition is dismissed at this stage. However, it is clarified that this order would not preclude the petitioner for a parole or a furlough after fulfilling the criteria as specified in Rule 1223(i) of the Delhi Prison Rules.
