We are of the opinion that the issue needs some more detailed deliberation by the learned Single Judge. One of the chief aspects of the matter which needs to be considered is whether the Appellate Authority, who has decided the appeal filed by the appellant, was competent to do so, or whether he was junior to the Disciplinary Authority.

As such, keeping all issues open for consideration by the learned Single Judge in remand, we set aside the impugned order and remand the matter to the learned Single Judge for consideration afresh. 3.

All issues of fact and law shall be left open for agitation before the learned Single Judge.

For the said purpose, let both sides appear before the learned Single Judge on 7 November 2024. We request the learned Single Judge to decide the matter as expeditiously as possible keeping in mind the fact that the punishment order is of 2005 and the writ petition itself was of 2012.
