The petitioner/applicant, who is facing a murder trial, seeks interim bail in order to take care of his ailing wife.

The application in question was earlier taken up on 25.06.2025 and the State was directed to submit status report with respect to medical condition of the wife of the petitioner/applicant.

Such status report has been furnished today. Copy has been duly supplied to learned Senior Counsel for the petitioner/applicant also. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The status report does indicate that the wife of the petitioner/applicant is admitted in ICU of RLKC Metro Hospital, Pandav Nagar. The reasons of her admission into the ICU have also been given as under:- "A.
Severe and recurrent loss of vision of right side of the right eye.
B.
Recurrent excruciating headache.
C.
severe vomiting not able to accept orally.
D.
Recurrent loss of the power on the right side of the hand with severe tingling and numbness of the right upper limb. E.
Hemodynamically unstable."

It seems that the wife of the petitioner/applicant has to undergo surgery on account of her such abovesaid medical condition but it shall be considered only when her any relative is available.

Mr. N. Hariharan, learned Senior Counsel for petitioner/applicant, on instructions, submits that the wife of the petitioner/applicant was admitted to the hospital by her neighbours only and there is no other family member to take her care. It is submitted that family members of the petitioner/applicant have already disowned him and since the marriage in question was a love marriage, nobody from the side of the in-laws of the petitioner/applicant is also willing to come forward to take care of his ailing wife. 7.
During course of the arguments, learned Senior Counsel for petitioner/applicant, on instructions and without prejudice to his rights and contentions, submits that keeping in mind the grave urgency, the request, at the moment, may be only confined to the grant of custody parole. He submits that once the petitioner/applicant is permitted to meet his ailing wife and if the situation so warrants, he may, however, be given liberty to move an application afresh to seek interim bail to take requisite care of his wife. 8.

custody parole, citing high risk involved in the matter. He submits that the petitioner/applicant is having bad antecedents and there is gang-rivalry going on and if he is permitted to release on custody parole, he may invite some risk to his own life as well.

However, keeping in mind the overall facts and circumstances of the case and the fact that the medical condition of the wife of the petitioner/applicant has been verified and that there is no other relative or acquaintance ready to take care of wife of petitioner/applicant who is admitted in ICU of RLKC Metro Hospital, the abovesaid limited request is acceded to and accordingly, the Superintendent Jail is directed to make adequate security arrangements, particularly, keeping in mind the status of the petitioner/applicant, who is a high-risk undertrial, to ensure that he is in a position to meet his ailing wife at RLKC Metro Hospital, Pandav Nagar, Delhi tomorrow, i.e. 01.07.2025 between 10:00 a.m. to 4:00 p.m. 10.
During such custody parole, the petitioner/applicant would be permitted to meet his ailing wife and to consult the concerned doctor(s) only. 11.
Application stands disposed of in the aforesaid terms. 12.
Liberty, as prayed for, is also granted.
