This transfer petition, under Section 24 of the Code of Civil Procedure, 1908 („CPC‟) has been filed seeking transfer of HMA Petition 367/2011 (Sumeeta Tuli Kapur v. Rakesh Lal Kapur) presently pending before the learned Family Court, South District, Saket Courts, New Delhi, filed by respondent to the competent Court of Patiala House Court, New Delhi.

Respondent, Smt. Sumeeta Tuli Kapur appears in person. She opposes the present petition and states that the petitioner has filed his case before Patiala House Courts, Delhi only in the year 2024 itself whereas she had filed the aforesaid HMA petition in the year 2011 before the Saket Courts and till date, the petitioner had raised no objection to the same. 3.

short the controversy, this Court may transfer the case filed by the petitioner before Patiala House Court to Saket Courts, New Delhi. 4.

Respondent says she has no objection to this request made by learned counsel for petitioner.

Accordingly, HMA Petition 458/2024 (Wg. Cdr. Retd. Rakesh Lal Kapur Vs. Sumeeta Tuli Kapur) presently pending before the learned Family Court, District New Delhi, Patiala House Courts, New Delhi is transferred to the competent Court of Saket Courts, New Delhi. 6.

Registry at Saket Courts, New Delhi is directed to take expeditious steps to ensure transmission of the record of the case. 7.

On the date already fixed in HMA Petition 367/2011, the present matter i.e. HMA Petition 458/2024 (Wg. Cdr. Retd. Rakesh Lal Kapur Vs. Sumeeta Tuli Kapur) would now be taken up by the competent Court at Saket Courts, New Delhi.

The transfer petition stands disposed of in aforesaid terms. 9.
