The present proceedings are instituted under Section 482 Cr.P.C. on behalf of the petitioner seeking quashing of FIR No. 654/2021 registered under Section 420 IPC at Police Station Kalkaji, New Delhi. 2.
The only ground raised in the present petition is that the agreement to sell records that the physical possession has been handed over to the complainant. Learned APP submits that vide the said agreement, the petitioner had in fact sold a piece of land which was not belonging to him and as per verification report from the L&DO, the said land was found to be government land. In support, learned APP also refers to the finding recorded to this effect in the judgment dated 27.04.2020 passed in W.P. (C) 3607/2011 titled Rajveer Sharma v. Union of India & Ors. 4.
In view of the above, no ground to entertain the present petition is made out. The petition is accordingly dismissed along with pending application.
