% 08.07.2024 CM APPL. 37615/2024[Application seeking direction] 1.

This is an Application under Section 151 of the Code of Civil Procedure, 1908 filed on behalf of the Petitioners seeking the following prayer:

"a. Direct the Respondent No.1 to continue with the services of the Petitioners during the pendency of the present writ petition ;" 2.

The learned Counsel for the Petitioners submits that after the Court proceedings were over on 05.07.2024, the ADM, SDM, Sub Registrar, Section Officer, and Account Officer removed the Petitioners from their services and at 3 pm, the Petitioners were directed to vacate their offices despite the pendency of the present proceedings. 3.

The learned Standing Counsel appearing on behalf of the Respondent No.1 refutes the above contention.

Undisputedly, the disputes between the parties under Section 33 A of the Industrial Disputes Act, 1947 are pending adjudication in ID No. 286/2022 before the learned Labour Court No-II, New Delhi [hereinafter referred as "Labour Court"].

Learned Counsel for the parties, on instructions, submit that they will file an appropriate Application in relation to the interim protection granted by the learned Labour Court.

In the meantime, in order for the Petitioners and the Respondents to file an appropriate Application, the interim order dated 26.03.2024 passed in I.D No. 286/2022 pending in the Labour Court is extended for a period of two weeks from today.

However, nothing contained herein shall tantamount to an expression on the merits of the case and the parties are at liberty to raise all contentions before the Labour Court.

Learned Counsel for the parties submit that in view of the order dated 05.07.2024 and the order passed today in CM APPL 37615/2024, nothing further survives in this matter.

Accordingly, this Petition and all pending Applications are disposed of.

The next date of hearing i.e., 12.07.2024 stands cancelled. 11.
