By way of present petition filed under Section 482 Cr.P.C., the petitioners seek setting aside of the order dated 23.08.2023 passed by the learned MM-01, NI Act (Central), Tiz Hazari Court in Complaint Case No.10443/2018, arising out of proceedings initiated under Section 138 NI Act.

Vide the impugned order, learned MM has directed initiation of the proceedings under Section 82 Cr.P.C against the accused. 3.
Learned counsel for the petitioners submits that the petitioners' absence before the trial court was unintentional. He further submits that the petitioners' undertake to appear before the trial court on the next date of hearing i.e., 16.02.2024. The petitioners' undertaking is accepted, taken on record and they are made bound by the same.

Considering the aforesaid, subject to the petitioners appearing before the trial court on the next date of hearing i.e., 16.02.2024, the order dated 23.08.2023 is set aside.
