Two separate applications under Section 482 of the Code of Criminal Procedure, 1973 („Cr.P.C.‟) have been preferred on behalf of the petitioner for directing respondent i.e. SHO, P.S.: Rajouri Garden to take necessary steps for de-sealing of the lift in compliance of order dated 05.07.2024 and in the meanwhile for interim de-sealing.

Issue notice. Learned ASC for the State appears on advance notice and accepts notice.

Learned ASC for the State informs that despite the order of this Court directing competent authority to pass necessary orders for the purpose of de-sealing of lift after conducting mechanical inspection, the orders have not been complied except for issuing notice to Mechanical Inspector, 5 Shyam The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Apparently, steps have not been taken for compliance of order dated 05.07.2024 in letter and spirit, except for issuing a notice to the Mechanical Inspector, 5 Shyam Nath Marg, Civil Lines, New Delhi, in a routine manner. SHO concerned is directed to appear on the next date of hearing and show cause as to why the directions issued by this Court vide order dated 05.07.2024 have not been complied with.
In the meantime, steps shall also be taken to serve the Mechanical Inspector through IO /SHO and ensure that mechanical inspection is positively carried out within three working days from the issue of this order, failing which, the concerned officer shall appear before this Court on the next date of hearing.
