O R D E R

% 15.10.2019 IA 14275/2019 This joint application has been filed by the parties with the following prayers:

"In light of the facts and circumstances set out hereinabove, it is most humbly prayed that this Hon'ble Court may graciously be pleased to:- a) pass an Order taking on record the Memorandum of Understanding dated 10.10.2019 executed between the parties;

b) pass an Order to vacate the interim order passed vide the common order dated 27.09.2019; and c) pass such other / further order(s) / direction(s) as this Hon'ble Court may deem fit in the interest of justice, equity and fair play."

Even though the present petition was disposed of by this court vide

order dated September 27, 2019, it is noted that the parties have settled their inter-se disputes without approaching the learned Arbitrator. The memorandum of understanding dated October 10, 2019 is annexed at Pages 4 to 9 of the list of documents under the heading 'Defendants' Documents'. Learned counsel for the parties states that the parties shall adhere to the terms of the memorandum of understanding. The same be taken on record and the order dated September 27, 2019 be vacated. Noting the submissions made by the counsel for the parties, the memorandum of understanding dated October 10, 2019 at pages 4 to 9 under the heading 'Defendants' Documents' is taken on record. I also take on record the submission made by the counsel for the parties that the parties shall adhere to the terms of the memorandum of understanding. In view of the understanding arrived at between the parties the order dated September 27, 2019 shall stand vacated. Application stands disposed of.
