The present Petition under Article 226 of the Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the petitioner seeking the Writ of Mandamus directing the respondent to release him on second spell of furlough of two weeks simultaneously along with the co-accused. 2.

Mr. Yasir Rauf Ansari, learned Additional Standing Counsel appearing on advance notice, accepts notice on behalf of the State. 4.

It is submitted in the petition that the petitioner has his Master of Arts, Hindi examination from 09.07.2024 to 18.07.2024. 5.

furlough of two weeks vis-a-vis., the petitioner has already been allowed vide Order dated 04.07.2024 and no further direction in this regard is required to be passed.

Learned counsel for the petitioner submits that he has an apprehension that even though the Order dated 04.07.2024 granting furlough of two weeks has been made, the petitioner may still be deprived of the benefit since his brother who is also a co-accused, is already on furlough. 7.

Learned Additional Standing Counsel for the State submits that this apprehension of the petitioner is misfounded in view of the Order dated 04.07.2024 granting two weeks of second spell of Furlough. 8.

In view of above, there is no further direction is required to be passed and the petition is disposed of.
