Learned counsel for the petitioner submitted that his only grievance is that the petitioner, who is aged around 82 years, is not in a position to attend the Court on each and every date and the petitioner may be exempted from her personal appearance before the Trial Court and notice under Section 251 of the Code of Criminal Procedure, 1973 may be served upon the petitioner through counsel. Learned counsel for the petitioner also submitted that he shall move an application to this effect before the Trial Court and the Trial Court may be directed to consider

the same, taking into consideration all the facts as well as the submissions made in the application and dispose of the same. 2.

Accordingly, the Trial Court is directed to consider the application, if any, moved by the petitioner and dispose of the same in accordance with law.

3. In view of the aforesaid, learned counsel for the petitioner seeks permission to withdraw the petitions. Accordingly, the petitions are dismissed as withdrawn. Pending applications are also dismissed as withdrawn.
