This is a petition under Section 482 Cr.P.C challenging the order dated 07.09.2022 passed by the Additional Sessions Judge (PC Act) in complaint case no.
02/2021 titled as 'DIRECTORATE OF ENFORCEMENT VS. ALCHEMIST TOWNSHIP INDIA LTD. AND ORS.'

Petitioner is the Resolution Professional ['RP'] who has preferred the present petition against the impugned order whereby an application of the RP for issuing directions to the respondent to release and handover the documents and data seized during the search on 19.09.2019 from the premises of Corporate Debtor to the petitioner was rejected. 3.
It is an admitted fact that during the search on 19.09.2019 certain documents and data were seized from the premises of Alchemist Township The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. India Limited. Section 21(2) of the Prevention of Money Laundering act, 2002 [PMLA] provides that person from whom the record is seized or frozen shall be entitled to obtain the copies of the record. 4.
In Sarla Gupta and Anr. v. Directorate of Enforcement (2025) SCC Online SC 1063, the Hon'ble Supreme Court held that so far as the seized documents and record are concerned, the person from whom or from whose premises the seizure has been made, is entitled to get the true copies thereof.

Petitioner, being the RP has stepped into the shoes of the Corporate Debtor Alchemist Township India Limited, and is therefore entitled for the copies of the documents and data seized during the search on 19.09.2019. 6.
Mr. Hossain, learned counsel who appears for the ED states under instructions that the department has no objection to provide copies of the documents and data so seized during the search on 19.09.2019 from the premises of Alchemist Township India Limited in terms of Section 21(2) of PMLA.

In view of Section 21(2) of PMLA and the concession granted by the respondent-department, the petition is allowed with direction to the respondent to provide copy of the documents and data seized during the search on 19.09.2019 from the premises of Alchemist Township India Limited to the petitioner herein within a period of six weeks from today. 8.
The petition accordingly stands disposed of.
