Learned senior counsel for the Respondent No.3 states that the unauthorized construction including the girders in question have been removed by the said Respondent.

Learned counsel for the Respondent No. 1, MCD confirms the said fact.

In view of the aforesaid, Respondent No. 3 is permitted to carry out repairs in its property No.13-16, Bagh Diwar, Fatehpuri, Chandni Chowk, Delhi-110006 in accordance with law. However, the MCD officials are directed to keep a strict vigil over the property. The Court Commissioner is directed to visit the premises and file a fresh report.

With the aforesaid direction, the present petition stands disposed of. However, in the event the Court Commissioner's report discloses breach of any law, the parties are at liberty to file an application before this Court in accordance with law.
