The present application filed under Section 483 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Sections 439 and 482, respectively, of the Code of Criminal Procedure, 1973) seeks regular bail in the proceedings arising from FIR No. 78/2023 at P.S. Wazirabad, New Delhi. A chargesheet under Sections 302, 325, 147, 149, 201 and 34 of the Indian Penal Code, 1860, has also been filed against the Applicant.

Mr. Tarang Srivastava, APP for State, states that the matter is still under trial and presently, statements of only two public witnesses have been recorded.

After making some submissions, Counsel for the Applicant states that he would like to withdraw the present application.
