% 23.09.2025 CM APPL. 60791/2025 By way of the present joint application filed on behalf of the appellant and the respondent under Order XXIII Rule 3 read with section 151 of the Code of Civil Procedure 1908, the parties seek disposal of the appeal in terms of Agreement of Settlement/Compromise dated 08.09.2025 signed between them; and pray that judgment and decree dated 06.06.2020 passed by the learned Additional District Judge, Central District, Tis Hazari Courts, Delhi in suit bearing CS No.319/2025 be modified in terms of the Agreement of Settlement/Compromise.

Counsel are present on behalf of the parties, alongwith the parties. The parties affirm the terms of the Agreement of Settlement/Compromise and undertake to be bound by them. Accordingly, the present appeal is disposed-of, setting-aside judgment and decree dated 06.06.2020 by consent of parties; and directing that the matter stands disposed-of in the terms contained in Agreement of Settlement/Compromise dated 08.09.2025, holding the parties bound by the terms thereof.

The terms of Agreement of Settlement/Compromise dated 08.09.2025 shall be deemed to be incorporated in the present order. 5.

The appeal is disposed-of in the above terms. 6.
