O R D E R

% 03.02.2017 Present FIR No. 249/2015 under Sections 498-A/406/34 IPC was registered at police station Bawana against the petitioner no.1 and his family members, i.e., petitioner nos. 2 to 5, on the complaint of respondent no.2. It is submitted that petitioner no.1 and respondent no.2 have settled their disputes amicably before the Delhi Mediation Centre, Rohini District Courts, Delhi on 29th March, 2016. Respondent no.2 is present in Court and has been identified by ASI Subhash of police station Bawana. She submits that their marriage has already been dissolved by a decree of divorce by mutual consent on 27th October, 2016.

She further submits that she has

already received `6 lacs out of the total settled amount, i.e, `9 lacs. Balance amount of `3 lacs has been paid by the petitioner no.1 to the respondent no.2 today in Court by way of demand draft bearing no. 687191 dated 26th December, 2016 drawn on Allahabad Bank.

Keeping in mind that petitioner no.1 and respondent no.2 have settled their disputes amicably and their marriage has already been dissolved, no fruitful purpose would be served in keeping the criminal proceedings pending.

Accordingly, in the interest of justice, FIR No. 249/2015 under Sections 498-A/406/34 IPC registered at police station Bawana and the consequent proceedings emanating therefrom are quashed. Writ petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
