% 09.10.2025 Mr. Krishna, learned counsel appearing for the appellant seeks leave to withdraw the present appeal submitting, that the matter has been settled with the respondent before the learned Executing Court, Panchkula, Haryana.

Counsel also requests that the court fee affixed on the memo of appeal be refunded to the appellant.

In view of section 16-A of Court Fees Act 1860 (as applicable to Delhi), 50% of the court fee affixed on the memo of appeal is directed to be refunded to the appellant within 02 weeks of the appellant approaching the Registry in this regard.

The Registry is directed to draw-up the requisite certificate in favour of the appellant for refund of the court fees. The appeal is disposed-of as withdrawn.
