The petitioner has filed this petition under Section 11 of the Arbitration and Conciliation Act, 1996 ["the Act"], for appointment of an arbitrator to adjudicate the disputes between the parties, under an agreement dated 12.07.2018 ["the Agreement"]. 2.

Clause 17 of the Agreement provides for arbitration by a sole arbitrator. Disputes having arisen between the parties, the petitioner invoked arbitration by a legal notice dated 27.04.2022. The said communication did not elicit a response, which has led to the filing of this petition under Section 11 of the Act.

Mr. M. C. Kochhar, learned counsel, has entered appearance on behalf of the respondent pursuant to notice issued on 08.07.2024. He submits that the existence of the arbitration agreement is undisputed, and the matter, therefore, be referred to arbitration leaving all rights and contentions of the parties open for adjudication by the learned arbitrator. Learned counsel on both sides are agreeable to a reference being made under the aegis of Delhi International Arbitration Centre ["DIAC"]. 5.

In view of the aforesaid statement, and with the consent of learned counsel for the parties, the disputes under the Agreement dated 12.07.2018 are referred to the arbitration of Hon'ble Mr. Apoorv Kurup, Advocate [Tel: 8800332253]. The arbitration will be held under the aegis of Delhi International Arbitration Centre, Delhi High Court, Shershah Road, New Delhi-110503, and will be governed by the Rules of DIAC, including as to the remuneration of the learned arbitrator. 6.

The learned arbitrator is requested to furnish a declaration under Section 12 of the Act, prior to entering upon the reference. 7.

It is made clear that all rights and contentions of the parties are left open for adjudication by the learned arbitrator.
