O R D E R

% 09.03.2019 Parties have mutually agreed to resolve the subject matter and thereunder, the respondent Insurance company has agreed to pay a sum of Rs.23,00,000/- (Rupees twenty three lakhs only) over and above the amount payable in terms of the impugned award towards full and final settlement. Out of this enhanced amount of Rs. 23,00,000/-, Rs.2,30,000/- (Rupees Two Lakhs Thirty Thousand only) shall be released to the appellant. The remaining amount shall be held in Fixed Deposits in consonance with the impugned award, within four weeks from today, failing which, the entire amount of Rs.23,00,000/- shall carry interest @ 9% p.a. from today.

Liberty is however, reserved to the claimant to approach concerned MACT, for release of such amount as may be required in case of exigencies

in the interest of the claimant, which shall be duly considered. The impugned award stands modified to that effect. Consequently, the appeal shall stand disposed of.
