The present bail application is filed seeking pre-arrest bail in FIR No. 303/2024 dated 12.06.2024, registered at Police Station Pahar Ganj, for offences under Sections 420/406/34 of the Indian Penal Code, 1860 (IPC).

The Investigating Officer (IO) is present in Court today. He submits that the complainant has joined investigation and has handed over a Memorandum of Understanding (MOU) between Synergy Tradeco NV (hereafter 'Synergy') and M/s Chemrow India Private Limited (hereafter 'Chemrow').

The FIR was registered on a complaint given by Mr. Manish Sharma, the Director of Chemrow, alleging fraud and cheating by Synergy. It was alleged that the applicant represents Synergy and had entered into four sale orders for supply of Ethylene-Vinyl Acetate.

The complainant alleged that shipments were received from Synergy and the material was found to be defective. 5.
The MOU, as handed over by the IO, mentions that the present FIR has been registered at the instance of Chemrow and the accused, Synergy has agreed to compensate for the losses suffered by Chemrow. The complainant company has also agreed that it has no objection if the present FIR is quashed. 6.
The photocopy of the MOU is taken on record.

In view of the above, the present bail application is allowed and the applicant, in the event of arrest, is directed to be released on bail on furnishing a personal bond for a sum of ₹25,000/- with two sureties of the like amount, subject to the satisfaction of the concerned SHO, on the following conditions: i.
The applicant shall join and cooperate with investigation as and when directed by the Investigating Officer;
ii.
The applicant shall not leave the country without the permission of the learned Trial Court;
iii.
The applicant shall not tamper with the evidence in any manner.
