The instant petition has been filed challenging the orders dated 18th November, 2022 and 18th April, 2023 passed by the learned CGIT-II in I.D. No. 180 of 2021.

Learned counsel appearing on behalf of the petitioner submitted that the matter is pending before the learned CGIT and vide order dated 18th November, 2022, it directed to maintain status quo with respect to the issue qua the advertisement dated 30th July, 2021, issued for filling up posts having similar nature of work as discharged by the respondents. He further submitted that the petitioner had moved an application seeking modification/clarification of the aforementioned order which was rejected by the learned CGIT vide order dated 18th April, 2022. 3.

prayer that since the department has already reserved 25 posts pertaining to the nature of work carried out by the respondents 1 to 25, the orders dated 18th November, 2022 and 18th April, 2023 passed by the learned CGIT-II in I.D. No. 180 of 2021 may be modified to the extent that post reserving 25 posts as undertaken by the petitioner, on instructions, the recruitment process may be continued for the remaining posts during the pendency of the proceedings before the learned CGIT.

Learned counsel appearing on behalf of the respondents has no objection to the above submissions made by the learned counsel for the petitioner.

Heard both the parties and perused the record. Learned counsel for the petitioner undertakes to reserve 25 vacancies qua the respondents herein.

In view of the above, this Court is of the view that the orders dated 18th November, 2022 and 18th April, 2023 are modified to that extent that after reserving 25 vacancies qua the respondents, the petitioner may continue with the recruitment process, as per the advertisement dated 30th July, 2021.

Accordingly, the instant petition along with accompanying applicaiton is disposed of.
