The present writ petition has been filed for quashing the order dated 19th February, 2021, passed by the Administrative Officer, Land & Estate Department (L&E) of the respondent. There is a further prayer for direction to the respondent to decide the application of the petitioner for regularization of the license of Shop No. 43, Kamla Market, New Delhi, by a Speaking Order, and in a time bound manner.

petitioner had filed an application for grant of ownership rights in respect of the Shop No. 43, Kamla Market, New Delhi. However, the said application is still pending with the respondent. Subsequent representations by the petitioner, are also pending with the respondent and no order as regards thereto, has been passed till date. Thus, the present writ petition has been filed.

Responding to the present writ petition, learned counsel appearing for respondent-Municipal Corporation of Delhi ("MCD") submits that he has instructions to submit that the respondent shall decide the representations made by the petitioner, within a period of eight weeks from today. 4.

Learned counsel appearing for the petitioner submits that the petitioner shall be satisfied, if the respondent decides the representation of the petitioner within a time bound manner.

Accordingly, without going into the merits of the case, it is directed that the representation of the petitioner with regard to Shop No. 43, Kamla Market, New Delhi, shall be decided expeditiously by the respondent. This Court notes the submission made by learned counsel appearing for the MCD that since the present writ petition contains all the documents and the averments of the petitioner, the present writ petition shall be treated as a Representation by the MCD.

Accordingly, it is directed that the present writ petition shall be treated as a Representation by the MCD and the same shall be decided expeditiously, preferably, within a period of eight weeks from today. 7.

The petitioner shall be granted personal hearing at the time of deciding the representations made by the petitioner. If, in case, the petitioner is aggrieved by any order passed by the respondent-MCD, the petitioner shall be at liberty to seek his remedies in accordance with law.

It is clarified that this Court has not expressed any opinion on the merits of the case, which shall be decided on its own merits by the respondent-MCD.
