Petitioner has approached this Court seeking quashing of FIR No.39/2022, dated 25.06.2022, registered at Police Station Cyber Police Station Outer North, for offences under Section 420 IPC, on the ground that the matter has been settled between the parties. 2.

Respondent No.2, who is a retired Indian Air Force Officer, has filed the instant FIR. The allegations against the Petitioner are of cheating and financial fraud. On the said complaint, the instant FIR was registered. 3.

settlement agreement dated 08.05.2024 which has been filed along with the petition.

Today, the Petitioner and the Complainant/Respondent No.2 are present in the Court. The petitioner and the Respondent No.2 have been identified by their respective Counsels and the Investigating Officer. The Complainant/Respondent No.2 has filed an affidavit affirming the fact that he has amicably settled all his disputes with the Petitioner out of his own free will, without pressure, coercion or undue influence. He states that he has received full and final amount of Rs.10,56,000/- from the Petitioner and wants to quash the present proceedings.

Considering the fact that the disputes are purely private in nature, the instant case is squarely covered under the judgment of the Supreme Court in Gian Singh v. State of Punjab, (2012) 10 SCC 303. 6.

In view of the settlement arrived at between the parties, this Court is of the opinion that no useful purpose will be served in continuing with the present proceedings. Resultantly, FIR No.39/2022, dated 25.06.2022, registered at Police Station Cyber Police Station Outer North, for offences under Section 420 IPC and the proceedings emanating therefrom are hereby quashed. The parties shall remain bound by the terms of the settlement and the undertaking given to the Court.

The petition stands disposed of with the above observations along with the pending application(s), if any.
