This is a petition seeking quashing of FIR No. 1463/2014 filed under Sections 420/468/471 of IPC registered at PS Shakarpur alongwith consequential proceedings arising therefrom. Charges have been framed under Sections 420/471 IPC.

As per the FIR, the petitioner is a delivery boy who was delivering phones from the service centre to the Micromax showroom. On opening the mobile phone boxes, there was no instrument but only soap case was found. 3.
The FIR was registered at the instance of Mr. Rohit Chauhan i.e. owner of the showroom of the service centre.

During the pendency of the proceedings, the parties have arrived at a settlement dated 09.05.2024, wherein the petitioner has agreed to pay Rs. 60,000/- to respondent No. 2.

Petitioner is present in court and is identified by Mr. Vishal Raj Sehijpal, Adv. Parties state that they have arrived at the settlement out of their own free will without any threat, pressure, coercion or undue influence. 7.
I am convinced that quashing of such proceedings on account of compromise would bring about peace and would secure ends of justice. The Court does not see any fruitful purpose if criminal proceedings as permitted to continue any further. It is a fit case for quashing. 8.
I am also of the view that in the present case, despite the fact that the FIR is of the year 2014, the chargesheet has only been filed in the year 2023 and no evidence has begun yet.

However, in my considered opinion, considerable judicial time has been wasted. Hence, the parties must do some social good. 10.
For the said reasons, FIR No. 1463/2014 filed under Sections 420/468/471 of IPC registered at PS Shakarpur along with all consequential proceedings are hereby quashed, subject to the petitioner paying a cost of Rs. 40,000/- to DHCLSC within 4 weeks from today. 11.
The proof of cost be placed on record within 6 weeks from today, failing which the file will be put up before the court. 12.
The petition is accordingly disposed of.
