The instant petition under Section 433 (e) read with Sections 434 and 439 of the Companies Act, 1956 read with Rule 9 of the Companies (Courts) Rules, 1959 has been filed on behalf of the petitioner seeking the following reliefs:

"(i) Direct that the Respondent Company be wound up under the provisions of the Companies Act, 1956;

(ii) Appoint the official liquidator as a receiver in respect of all the assets, properties and affairs of the Respondent Company. (iii) Award costs of the present proceedings in favor of the Petitioner Company and against the Respondent Company; and (iv) Pass such other and further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."
