The petitioner has approached this Court under Article 226 of the Constitution, against an order dated 01.09.2023, issued by the Ministry of Heavy Industries, Government of India, by which the petitioner was placed under suspension and transferred to Indore. 2.

Mr.

Manish Mohan, learned Central Government Standing Counsel, states that following the order of this Court dated 27.09.2023 staying the aforesaid order, the impugned order dated 01.09. 2023 has W.P.(C) 12861/2023 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. been recalled. He further states that the transfer of the petitioner has thus been revoked vide order dated 20.12.2023, and that the period of suspension has, in any event, lapsed.

Having regard to this position, Mr. Sanjoy Ghosh, learned Senior Counsel for the petitioner, does not press this petition, reserving all rights and contentions of the petitioner, including as to the identification of his employer, who, according to him, can alone take disciplinary action against him.

Accordingly, the petition, alongwith the pending application, is dismissed as withdrawn, with the aforesaid observations.
