O R D E R

% 18.01.2017 Present writ petition has been filed seeking a direction to respondent to re-install the electricity meter and to restore electricity connection of the premises bearing No.F-24, Ground Floor, Kalkaji, New Delhi. Petitioner further challenges bill dated 21st March, 2015 bearing connection No.151324239 for Rs.6,25,824/- and another bill dated 31st December, 2015 bearing connection No.150282183 for the sum of Rs.6,29,600/-.

It has been stated in the petition that petitioner purchased the aforesaid property on 30th April, 2011 and electricity meter having connection No.150282183 was installed in November, 2011. It has been further stated that respondent raised a bill dated 31st March, 2015 against the

connection No.151324239 for a sum of Rs.6,25,824/- which does not belong to the petitioner.

On 12th February, 2016 this Court had directed restoration of petitioner's electricity connection subject to payment of 20% of the bill amount of Rs.6,25,827.61/-.

Admittedly, the said order has been complied with and the petitioner's electricity connection has been re-energized on 16th February, 2016. Learned counsel for respondent states that the present writ petition is not maintainable as the petitioner has an alternative effective remedy under Section 42(5) of the Electricity Act, 2003.

Keeping in view the Division Bench judgment of this Court in Ram Kishan Vs. N.D.P.L., 130(2006) DLT 549 (DB), present writ petition is disposed of with liberty to the petitioner to approach Consumer Grievance Redressal Forum.

In the event, petitioner approaches the Consumer Grievance Redressal Forum within a period of eight weeks, the interim order dated 12th February, 2016 shall continue to operate till the petition filed by the petitioner before the Consumer Grievance Redressal Forum is decided. With the aforesaid liberty and direction, present writ petition stands disposed of.
