The petitioner has filed the present petition, inter alia, praying that FIR No.0041/2019, under Sections 420/406/34 of the IPC registered with Police Station Vivek Vihar and all proceedings emanating therefrom, be quashed.

Notice to respondent no.3 was issued on 25.09.2019. Respondent No.3 had appeared in person on 13.11.2019 and had sought time to file the reply. However, the same has not been filed, as yet. 3.

The learned counsel appearing for respondent no.1 has filed a status report indicating that after investigation, it was found that a criminal offence has not been committed. The cancellation report has been prepared and will be filed before the concerned court within a period of one week.

In view of the above, the learned counsel appearing for the petitioner seeks to withdraw the present petition with liberty to file afresh, if the FIR in question is not closed.
