O R D E R

This suit is disposed of with the consent order that defendant will not use the trademark 'ORKASH' or any other trademark or trade name deceptively similar to 'ORKUS', the registered trademark of the plaintiff. It is proposed to by the defendant, and agreed by the plaintiff, that defendant can use as its trademark 'AMKASH'.

It is also agreed that whatever existing stocks which the defendant has under the trademark ORKASH Electricals, the same can be disposed of by the defendant latest by 31.3.2019. Defendant will withdraw their registration with respect to the word mark ORKASH and also will take all other incidental steps so required in law for the defendant no longer remaining the owner of trademark ORKASH.

Suit is accordingly disposed of in terms of the aforesaid consent order leaving the parties to bear their own costs and binding the parties to their stands as reflected in the present order.
