The present petition seeks setting aside of order dated 09th December, 2021, whereby the Court of CMM, South, District-Saket, had on an application filed by Respondent No. 2 under Section 156(3) of the Code of Criminal Procedure, 1973, directed registration of an FIR. 2.

Pursuant to above direction, the FIR was registered; and on completion of investigation, a final report under Section 173 Cr.PC is in the process of being filed.

In light of the above development, counsel for the Petitioner seeks leave to withdraw the present petition reserving all rights and contentions to be raised before the Trial Court at the appropriate stage. 5.

In light of the above, leave and liberty, as prayed for, are granted. Pending applications also stand disposed of.

The State is permitted to file the chargesheet without arrest, before the Trial Court.

All rights and contentions of the parties are left open. The Court has not commented on the merits of the case.
