This is one of any number of cases which have been coming up before this Court in which we find that prayers for refixing seniority are made without impleading affected parties. 2.

We fail to understand why despite the law having been settled by the Supreme Court in a number of authorities including State of KUMAR 15:41:50 W.P.(C) 12911/2023 & connected matter

Rajasthan v Ucchab Lal Chhanwal1, Vijay Kumar Kaul v Union of India2, Indu Shekhar Singh v State of U.P.3, J.S. Yadav v State of U.P4 and Padam Singh Jhina v Union of India5, such petitions are being filed. We are not inclined to keep these petitions pending and allow impleadment at this stage.

Accordingly, these petitions are dismissed for non-impleadment of necessary parties. However, the petitioners would be at liberty to reinstitute the petitions, if so advised, after impleading the necessary parties.
