This hearing has been done through hybrid mode 2.

The present petition has been filed by the Petitioner- Mr. Sham Sundar Verma challenging the detention of the two gold chains weighing 200 grams (hereinafter referred to as 'the detained articles') which are claimed to be the personal effects of the Petitioner.

The case of the Petitioner is that he was travelling from Bangkok to India on 20th June, 2024 and admittedly, he had purchased the detained articles for the purpose of gifting at his daughter's wedding which took place on 10th November, 2024.

It is submitted on behalf of the Petitioner that the said articles were detained on 20th June, 2024 and the consequent Order-in-Original was passed on 19th July, 2024, ordering absolute confiscation of the detained articles. 5.

against the Order-in-Original dated 19th July, 2024, however, till date, the same has not been heard. Hence this petition has been filed by the Petitioner, seeking setting aside of the detention of his gold items. 6.

Mr. Singla, ld. Counsel has raised objections as to the notarisation of the affidavits in this petition, however, considering the fact that the same is now being disposed of, the said allegations are not gone into. 7.

Considering the fact that the Petitioner has already filed an appeal, in the opinion of this Court, at this stage, it is sufficient to direct that the appeal shall be heard in an expedited manner.

It is, accordingly, directed that the appeal filed by the Petitioner shall be heard by the appellate authority within a period of three months from the date of this order and an order shall be passed in accordance with law. 9.

Considering the delay in deciding of the appeal, the appellate authority shall also consider reducing the warehousing charges which the Petitioner is being forced to incur, in case there is any order directing the release of goods. 10.

The petition is disposed of in these terms. Pending applications, if any, are also disposed of.
