% 03.04.2018 Learned counsel for the petitioner submits that prosecutrix is aged about 25 years and has three year old child. Though prosecutrix was married but she fell in love with petitioner. Petitioner and prosecutrix were in a relationship. Certain photographs have been placed on record, wherein prosecutrix, petitioner as well as daughter of the prosecutrix are to be seen together. Learned counsel for the petitioner states that photographs indicate that prosecutrix was having intimate relations with the petitioner. After the husband of prosecutrix came to know about their relationship, prosecutrix has lodged the FIR. Transcripts of Whatsapp messages have also been placed on record. Learned APP has opposed the grant of bail to petitioner.
It is contended that prosecutrix has categorically alleged that petitioner had raped her. Allegations are
serious in nature.
Petitioner is in custody for more than five months. Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
Bail application is disposed of in the above terms. Dasti.
