The Petitioner seeks bail in the event of arrest in FIR No. 133/2023 dated 03.04.2023 registered at Police Station Chhawala for offences under Sections 420 & 34 IPC.

The FIR has been registered on a complaint given by one Rani Devi w/o Gurmeet Lal wherein she had stated that a 100 sq. yds. plot was purchased from one Trilochan Kaur w/o Jagdish Kumar. It is stated that she constructed the house in the year 2019. It is stated that during COVID-19 pandemic, she had left the house and had gone out of the city and when she came back on 10.05.2022, she found that the plot has been occupied by one Laxmi Sharma w/o Subhash. On enquiry, the said Laxmi Sharma informed that she had purchased the property from one Sunita w/o Ram Kumar. On this information, the instant FIR was filed.

This Court on 10.07.2024 directed the learned APP for file the Status Report. Status Report has been handed over in Court today. A copy of the Status Report has also been supplied to the learned Counsel for the Petitioner.

A perusal of the Status Report discloses that the investigation is at a nascent stage. It is also stated that investigation till now reveals that the Petitioner was actively involved in preparation of fake documents because of which such transactions took place. The Status Report also reveals that the Petitioner is involved in several other cases of preparation of such fake documents and he has been arrested on earlier occasions also. 5.

It is further stated that the Petitioner has not joined the investigation and NBW has been issued against him.

Since this case involves preparation of fake documents and the Petitioner has been arrested earlier, this Court is of the opinion that custodial interrogation might be necessary and, therefore, bail in the event of arrest in the present case should not be given at this stage of investigation. 7.

In view of the above, the petition is dismissed along with pending application(s), if any.
