versus UNION OF INDIA AND ANR ..... Respondent Through Mr. Vivek Goyal, Advocate for R-1.
CORAM:
HON'BLE MR. JUSTICE SANJIV KHANNA HON'BLE MR. JUSTICE NAJMI WAZIRI

% 15.02.2016 We are not inclined to interfere with the impugned order dated 29th January, 2016, granting an opportunity to the respondents to submit their reply to the original application. It is noticeable that the original application was filed on 20th January, 2016 and the petitioner herein was to retire on 31st January, 2016. In these circumstances, noticing the controversy in issue, the Tribunal felt that without reply they should not grant interim relief. Having heard counsel for the petitioner, we do not think that there is any justification or ground to interfere with the impugned
order dated 29th January, 2016.
The writ petition is accordingly dismissed.
We clarify that we have not expressed any opinion on merits or on the aspect if the petitioner succeeds, what would be the consequences.
