The present petition is filed by the petitioner seeking setting aside of the order dated 03.04.2025, passed by learned Additional Sessions Judge (SC-RC), South, Saket Courts, Delhi. 2.

The petitioner is essentially aggrieved by the fact that the CDR, CAF and other relevant details of her mobile number, for the period from 01.06.2023 to 27.02.2024 have been requisitioned from the service provider without issuing any notice to her.

It appears that the accused had filed an application to requisition such data in order to support his defence. 4.

From a perusal of the impugned order, it is pertinent to note that the petitioner had not been heard as well as the relevancy of such data has not been discussed by the learned Trial Court.

APP for the State submit that the present matter may be remanded back for directions to the learned Trial Court to pass an order after hearing the petitioner herein. 6.

In view of the above, the impugned order dated 03.04.2025 is set aside in so far as it relates to the data of mobile numbers of the petitioner.

The learned Trial court is directed to pass a fresh order after hearing the petitioner.

The petition stands disposed of along with pending application.
