The Petitioner is in custody in relation to FIR No. 444/2024 registered under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 19851 at P.S. Bhalswa Dairy. Subsequently, a chargesheet was filed qua the Petitioner under Sections 21/25/29 of the NDPS Act. 2.

The Petitioner was granted interim bail by order dated 17th June, 2025, passed by the ASJ-04, North District, Rohini Courts for a period of one week. Thereafter, the Petitioner filed another application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking extension of interim bail for a period of 45 days. By order dated 25th June, 2025, the Sessions Court partly allowed the request and extended the interim bail till today.

The Petitioner is aggrieved that an extension of his request for 45 days has been partly allowed. He seeks extension of bail for a further period of 30 days.

In the opinion of the Court, since there is no adverse order declining the Petitioner's request for extension of interim bail, the Petitioner should, at the first instance, approach the Sessions Court to explain the grounds justifying the extension sought.

Accordingly, the present petition is disposed of with liberty to the Petitioner to apply for extension of interim bail before the Sessions Court within 3 days from today, in accordance with law. Such a request shall then be considered on its own merits and in accordance with law. 6.

In the meantime, the interim bail granted to the Petitioner is extended till Monday i.e. 7th July, 2025 on the same terms and conditions stipulated by order dated 17th June, 2025. It is however clarified that this extension is only to allow the Petitioner to avail the remedies of seeking extension before the Sessions Court. This Court has not expressed any opinion on the merits of the case. All rights and contentions of the parties are left open. 7.
