CRL.M.A. 18572/2025 STAY 1.

This a petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, read with Section 482 Cr.P.C filed on behalf of the petitioner for quashing of summoning order dated 03.01.2024 and proceedings of complaint bearing CC No.1/2024 under Section 138 of NI Act pending before the Ld. JMFC, West District, Saket Courts, New Delhi. 2.

After part submissions, Mr. Saket Gogia, learned counsel for the petitioner seeks permission to withdraw the present petition reserving his rights to urge all his contentions before the learned trial court at the appropriate stage.

The statement made by learned counsel is taken on record and petition is dismissed as withdrawn.

At this stage, learned counsel for the petitioner states that petitioner is a resident of Bangalore and the matter is listed before the learned trial court on 04.07.2025 and therefore, has made a request that at least for tomorrow the personal appearance of the petitioner be exempted. 5.

The learned counsel is at liberty to make such a request before the trial court and upon which the learned trial court may grant liberty to appear through video-conferencing for tomorrow.
